1.1 The Carrier, a Civil Aviation Authority (CAA) approved AOC (Air Operators Certificate) aircraft operator.
1.2 The Charterer, any person, firm or body corporate chartering , or offering to charter – any aircraft or seat in the aircraft from the carrier.
1.3 The Aircraft, any aircraft or seat in the aircraft which is the subject of the charter agreement between the carrier and the charterer.
1.4 The Flight Schedule, the place of departure, place of destination and any stopping points together with any indications of departure and arrival times between the carrier and the charterer.
1.5 The Agreement, any arrangement between the carrier and the charterer, for the charter of aircraft or seats in the aircraft from the carrier.
2.0 Main Terms
2.1 The Carrier shall provide for the Charterers use, the aircraft, manned and equipped for the performance of the Flight Schedule.
2.2 Should the aircraft, for any reason, (whether before or after the commencement of the Flight Schedule) become incapable of undertaking, or continuing all or part of the Flight Schedule, the Carrier may at its discretion substitute therefore one or more aircraft of the same or another type, and the provisions of the agreement shall apply mutates mutandes to the substituted aircraft. If the Carrier does not substitute another Aircraft it shall not be under any liability to the charterer and the Charterer shall remain liable to pay for the part of the Flight Schedule (if any) that has been performed at the time the Aircraft becomes so incapable.
2.3 The Captain of the Aircraft shall have absolute discretion to:
2.3.1 Refuse any passenger(s), baggage or cargo or any part thereof.
2.3.2 Decide what load may be carried on the Aircraft and how it should be distributed.
2.3.3 Decide whether and when the Flight Schedule may be safely undertaken and where and when the Aircraft should be landed.
2.4 As aviation requires good weather conditions, the Flight Schedule is subject to cancellation at short notice.
2.5 The Carrier shall not be liable for any expenses incurred from changes or cancellations to the Flight Schedule due to operational circumstances.
2.6 If, for any reason, the Aircraft is diverted from any airfield or destination shown in the Flight Schedule to another airfield or destination, the journey to the said airfield or destination shall be deemed to be complete when the Aircraft arrives at the other airfield.
2.7 It should be noted that any Charterer failing to take their confirmed flight renders the Agreement completed. ln the event of the Flight Schedule being cancelled by us, then the Agreement remains and will be rebooked for a mutually convenient date.
2.8 Whilst every precaution is taken for the safety of the Charterer, the Carrier cannot be held liable for the loss, damage or injury which does not results from the Carrier’s negligence. Those wishing to take cameras and other photographic equipment on the flight do so entirely at their own risk.
2.9 A minimum age of 12 years is required for all trial lesson flights (adult supervision on airfield premises required for under 16 years). Passengers on trial lesson flights should be family or friends of the pilot who are sharing the experience with a view to learning to fly.
2.10 All passengers should ensure that they are in good health and if in doubt, should seek qualified medical advice.
3.1 Maximum weight per seat is 17 stone (108 kg) – please contact the Carrier if over 15 stone (95kg). Minimum Age is 6 years (By law Children from 2 years old must have their own seat when flying in a helicopter). The Carrier makes every effort to help Disabled Charterers – please contact the Carrier for more information.
3.2 No servant, agent or representative of the Carrier has authority to modify or waive any provision of this Contract.
4.0 General Hand Baggage
4.1 There are many items which are considered to be dangerous and cannot be carried as hand baggage on any flight.
4.2 For safety reasons there are restrictions in place on liquids, gels and pastes being carried in hand baggage.
4.3 Passengers are reminded not accept articles or baggage from other persons, and not to leave baggage unattended.
4.4 Passengers may carry liquids such as toiletries including:
4.5 Pleasure ensure that vessels holding liquids contain no more than 100ml each.
5.0 Prohibited Articles
5.1 Prohibited articles include Sharp items such as scissors, knives of any description. Tools and sharp accessories including screwdrivers, imitation toy guns, hypodermic needles, sporting equipment or any items which may be considered to be a safety risk to the passengers or crew, are prohibited from the aircraft cabin and must be packed in Hold Baggage.
6.0 Dangerous Goods
6.1 Dangerous Goods are broken down into 3 categories:
6.2 To ensure the safety of their aircraft and all those on board, passengers’ checked in or hand baggage must not contain articles or substances that could pose a danger (some exemptions apply), these include Batteries which can short circuit and catch fire if they are carried loose in your bag. They must be protected against contact with other metal items (e.g. by being in their original packaging or own protective case) and carried in your hand baggage. Equipment containing such batteries should be carried in your hand baggage.
6.3 If you check in with dangerous goods that fit into category 1 or 2 without prior notification they will be confiscated under guidelines issued by the Department of Transport and the Civil Aviation Authority.
6.3.1 Dangerous goods which cannot be taken onto an aircraft
6.3.2 Dangerous goods for which you require approval to carry them on the aircraft;

6.3.3 Dangerous goods that you can lawfully carry on an aircraft include but are restricted to specific limits on quantities or dimensions
6.3.4 Items which are deemed dangerous or may affect the safety of the aircraft and/or its occupants will be confiscated. If you have any doubts regarding the suitability of an item, please contact the Operator. Further information on Dangerous items can be obtained from the Civil Aviation Authority.
6.4 (The following sections are NOT applicable to Purchasers or Flight Vouchers or Trial Lessons)
The Carrier shall use all reasonable endeavours to complete the Flight Schedule but shall be entitled without liability to depart from the Flight Schedule if necessary in their opinion and any additional expenses (Including fees such as landing, handling, navigation, ground support service, customs and airport surcharges) shall be borne by the Charterer.
7.0 Cancellation Charges
On confirmation of your booking a non-refundable booking fee of £75.00 + VAT is charged under all conditions and all circumstances including bad weather.

9.0 Payment Terms
9.1 We require a deposit of 50% of the total quote, to be paid on booking. The final payment is to be paid at the latest – 2 week before the Flights Schedule is due to commence.
9.2 Payments made by credit card will incur a surcharge of 3%. There are no additional charges for payments made by debit card, bank transfer or cheque.
9.3 If the hirer cancels, the above percentages of the hire will be payable (unless the cancellation is directly due to the Aircraft becoming unserviceable or to the weather not being flyable for the route of the hire).
9.4 Non account holders are required to secure payment of cleared funds by bank transfer, cheque or credit card prior to the flight taking place. In the event that a credit card is used as security for payment, the option to settle within three days of invoice will be granted. Interest on any delayed payment will be charged at 2% interest on the amount overdue, per month or part of a month compounded monthly.
